These Terms of Service (“Terms”) govern your access to and use of fathomscience.com and related subdomains (the “Site”), operated by Fathom Science, Inc. (“Fathom Science,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Use of the Site

The Site is provided for informational purposes about Fathom Science, our products (including ARMS), and how to contact us. You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt unauthorized access to our systems, or misuse any content or contact form for spam or fraud.

Intellectual property

All content on the Site — including text, graphics, logos, and the “ARMS” and “Taking AI Out to Sea” names and marks — is owned by Fathom Science or its licensors and is protected by applicable intellectual property laws. Nothing on this Site grants you a license to use our trademarks, content, or technology except as necessary to view the Site in a standard web browser.

Third-party links and logos

The Site may reference or display the names and logos of partners, customers, or institutions we work with. These are used to identify those parties and do not imply their endorsement of Fathom Science beyond the relationship described. The Site may also link to third-party websites we do not control; we are not responsible for their content or practices.

No warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE ACCURATE, COMPLETE, SECURE, OR UNINTERRUPTED. NOTHING ON THE SITE CONSTITUTES OPERATIONAL, NAVIGATIONAL, SAFETY, ENGINEERING, OR OTHER PROFESSIONAL ADVICE, AND SHOULD NOT BE RELIED ON AS SUCH. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL FATHOM SCIENCE, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FATHOM SCIENCE’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so some of the above limitations may not apply to you in full.

Indemnification

You agree to indemnify and hold harmless Fathom Science and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
